Dan Louismet has over a decade of legal experience, the last 8 years being dedicated exclusively to providing legal counsel to franchised new motor vehicle dealers across Minnesota. Dan previously served as General Counsel for the Minnesota Automobile Dealers Association (MADA) where he counseled the Association's 365+ franchised new vehicle dealer members on issues involving Minnesota's franchise law, manufacturer disputes, employment issues, contract drafting and negotiation, compliance with state and federal laws, dealer licensing rules, consumer complaints, and advertising practices. Dan has seen it all when it comes to the issues dealers encounter on a daily basis. His experience working with dealers of all sizes and of every line-make offer a unique perspective and expertise not found among other attorneys.
Minnesota Statute 80E governs the relationship between a manufacturer and new motor vehicle dealer in Minnesota. This "franchise law" is the lifeblood for dealers as they manage the relationship with their manufacturers. Dan not only has a deep knowledge in this niche body of law, but he is also the author behind many of the recent changes to the law including warranty reimbursement, vehicle model availability, and dealership area of responsibility or "sales effectiveness."
Dan began his legal career as a labor and employment attorney where he litigated cases involving discrimination, discipline/termination, and employment misconduct, among other issues. While serving as General Counsel for MADA, he helped dealers through numerous matters involving FMLA, ADA, hiring/firing as well as general compliance with the many federal, state, and local laws and regulations that dealers are subject to.
Understanding the "fine print" requires specific knowledge and experience. Dan has reviewed, drafted, and negotiated hundreds of contracts unique to dealerships including dealer agreements, vendor agreements, and vehicle purchase agreements, to name a few. You can be confident knowing Dan understands what terms and conditions matter to your dealership and how to achieve positive results with your business partners.
A vehicle is often the most expensive purchase a person will make other than buying a home. With increased cost often comes increased regulation. Dan has successfully assisted dealers all over Minnesota in navigating the myriad of state and federal regulations that govern what a dealership can, can't, or must do. From Buyer's Guides and dealer warranties to menu pricing and privacy notices, Dan has helped numerous dealers successfully navigate the ever-growing regulatory minefield.
Not every sales or service customer winds up satisfied despite the best efforts of the dealership. Some of those customers complain directly to the dealership, state or federal regulatory agencies, or even conciliation or district court through a lawsuit. It is critical for the dealership to consult an attorney who understands the dealer's rights and responsibilities before responding to an unhappy customer. Dan has helped countless dealerships protect their interests and reputation. Experience and early strategy have a significant impact on the final outcome of a dispute.
Almost every new vehicle dealership in Minnesota is held to the "Minnesota Automotive Advertising Standards," in addition to state and federal regulations. These standards are enforced by the Better Business Bureau of Minnesota. Dan administered this program on behalf on the industry while serving as General Counsel for MADA. His deep understanding of these advertising standards makes him uniquely qualified to assist dealers with their advertising practices.
